The following terms and conditions are in addition to the Website Terms and Conditions and the Wireless Terms and Conditions which may be found at the Terms and Conditions link throughout our website.
You will be charged for your purchase of ringtones and/or graphics on your next bill or have it deducted immediately from your prepaid account balance at set rates. The only exception to set pricing is if Rogers has offered a particular ringtone or graphic free of charge. Applicable taxes will be added to your purchase price.
The following are required for service: a ringtone and/or graphics capable phone, subscription to a Rogers Wireless price plan or an available prepaid account balance, and text messaging enabled on your plan profile.
You will be charged data usage charges, plus applicable taxes, for all data traffic relating to ordering and receiving a ringtone or graphic while roaming outside the Rogers Wireless Network. If you are not on a data plan you will be billed in accordance with Rogers pay per use rate for roaming.
Each handset can only store a limited number of ringtones or graphics. If you purchase a ringtone or graphic and your phone memory is full. You will be charged for the download, it will be delivered to your phone, but you will have to delete one of your existing ringtones or graphics to store the new item.
Rogers cannot guarantee delivery of a ringtone or graphic at any given time since our delivery methods use a combination of public, corporate, and private networks which we have no control over.
You can only store a ringtone or graphic purchased through Rogers on the designated phone, and cannot forward, sublicense or disseminate such ringtone or graphic to another recipient directly from the handset, unless the graphic is a Picture Message.
If you order a ringtone or graphic and your phone is not compatible you will still be charged even if the phone cannot play the ringtone or display the graphic. Certain types of ringtones and graphics may only be used with certain phone models. You will be charged for your ringtone and/or graphic purchase when you download the ringtone and/or graphic, even if you choose to discard it. Rogers does not guarantee that your phone will reproduce the ringtone or graphic accurately.
The sound recording ("Recording") you are purchasing and the copyrights therein are the valuable intellectual property of the copyright owner and may be used by you solely in connection with your mobile handset as a musical "ringer". You may not transfer the Recording out of your handset via any means for any purpose. Any copying, redistribution or other use of the Recording is expressly prohibited without the prior written consent of the copyright owner.
